Fines imposed for illegal tyre dumping
The Light Regional Council and Adelaide Plains Councils have successfully prosecuted Mr Samuel John Durante of Para Hills, of four counts of illegal dumping in their respective areas.
Mr Durante has been using social media platforms to offer removal of old tyres from private properties for a fee. Judge Durrant in the ERD Court found that upon receiving payments from landowners, he subsequently illegally dumped the tyres in the public realm, causing environmental harm and creating an unsightly nuisance to the community.
As prosecuting authorities, both councils emphasise their commitment to protecting the environment from such environmental harm.
Judge Durrant in the ERD Court found Mr Durante by behaving in this manner has shown disregard of the law and as such has been convicted of multiple counts of illegally dumping a significant number of tyres on public land.
Mr Durante was fined a total of $12,000 and ordered to pay an additional $6,000 compensation to the respective councils, for costs incurred in the clean-up of the illegally dumped tyres. Mr Durante will also be required to pay $3,000 by way of prosecution legal fees.
Both Council’s warn the public that the dumping of any material by people who disregard the law is a costly and environmentally damaging practice. They urge the community to remain vigilant and ensure that persons and businesses engaged in providing services are genuine and are complying with their lawful obligations in disposing of waste.
Members of the public are encouraged to contact crime stoppers to report any instances of illegal dumping, which will then be forwarded to the relevant council for investigation.
