On 5 October 2023, Councillor John Lush resigned from his position as an elected member of the Adelaide Plains Council (Council). A copy of Council’s Media Release in relation to the resignation can be viewed here.

As a result, pursuant to section 54(b) of the Local Government Act (the Act), a casual vacancy (the vacancy) in office was created.

In accordance with section 54(6) of the Act, Council gave notice of the occurrence of the vacancy in the South Australian Government Gazette, which can be viewed here.

The process of filling the vacancy is run by the Electoral Commission of South Australia (ECSA) and is set out in section 6A of the Local Government (Elections) Act 1999 and regulation 3A of the Local Government (Elections) Regulations 2010.

Recount Results

• Four out of the six candidates who were unsuccessful in the November 2022 periodic election advised ECSA that they were willing to fill the vacancy.
• A recount was conducted on Wednesday 1 November 2023 at ECSA’s offices (81-95 Waymouth Street, Adelaide), with a provisional declaration made at 3.53pm on the same day.
• The results were officially certified by ECSA on Monday 6 November 2023 with Mr Carmine Di Troia declared elected to the position of area councillor.
• Mr Di Troia will be officially sworn in as an elected member at the 27 November 2023 ordinary meeting of Council.
